Il decreto Legislativo n. 124/210 rende obbligatoria l’istituzione del Registro delle varietà dei fruttiferi, in recepimento della Direttiva CE 2008/90. La registrazione delle varietà avviene sulla base di una serie di informazioni che riguardano denominazione, marchi commerciali, costitutore, eventuale brevetto e Centro di conservazione per la premoltiplicazione. Nel nuovo Registro entrano d’ufficio le varietà del Registro delle Accessioni del Servizio Nazionale di Certificazione Volontaria del Mi.P.A.A.F. e le varietà valutate dal CPVO per la concessione della privativa comunitaria. Dal 2017, le varietà, per essere iscritte, dovranno essere sottoposte al test DUS (Distinguibilità, Uniformità, Stabilità).
The Law by Decree no. 124/2010 makes compulsory the institution of the fruit varieties Register, according to the acknowledgement of the Directive EC 2008/90. The registration occurs on the basis of a series of informations regarding name of the variety, eventual brand, breeder, eventual legal protection and conservation Centre for pre-propagation. The new Register will include the varieties already recorded in the Register of the National Voluntary Certification Service of the Ministry of Agriculture and the varieties already examined by CPVO for the legal protection. Starting 2017, varieties, to be registered, must be submitted to the DUS test (Distinguibility, Uniformity, Stability).
