La recente emanazione del Reg. (UE) 2024/1143, oltre ad offrire sistematicità alla materia delle Indicazioni Geografiche, è intervenuta sul regime delle Specialità Tradizionali Garantite (STG) che, a distanza di oltre 30 anni dalla sua introduzione, non ha prodotto i benefici previsti per produttori e consumatori, poco o per nulla informati addirittura sul significato stesso di STG o sul suo valore.I numeri, del tutto incomparabili con quelli delle Indicazioni Geografiche, certificano un evidente insuccesso del fenomeno, le cui norme avrebbero dovuto essere «migliorate, chiarite e rese più efficaci».Pur a fronte del dichiarato obiettivo di «ottenere un regime più comprensibile, efficace e interessante per i potenziali richiedenti», permangono tuttavia le perplessità su una disciplina, di cui ancora si fatica a comprendere il potenziale e rispetto alla quale adeguare paradigmi e interpretazioni proprie delle norme in tema di Indicazioni Geografiche, anche in termini di tutela, non sembra la strada maestra per contribuire al successo.
The recent adoption of Regulation (EU) 2024/1143 has introduced a system for Geographical Indications and has also intervened in the Traditional Specialities Guaranteed (TSG) regime. Despite more than 30 years since its introduction, the TSG regime has not produced the expected benefits for producers and consumers, who are little or not informed about the meaning of TSG or its value.The number of TSGs, which is significantly lower than that of Geographical Indications, indicates a clear failure of the phenomenon, whose rules were intended to be “improved, clarified and sharpened”.Despite the declared objective of making the scheme “more understandable, operational and attractive to potential applicants”, perplexities remain about a discipline whose potential is still hard to comprehend and with respect to which adapting paradigms and interpretations of the rules on Geographical Indications, also in terms of protection, does not seem the right way to contribute to success.
